In Texas, spousal maintenance is available only under limited circumstances. To qualify, a spouse must show that he or she does not have enough income to meet his or her "minimum reasonable needs." In addition, a spouse seeking spousal maintenance must show at least one of the following:

  • The marriage lasted 10 or more years and the spouse cannot meet his or her reasonable needs.
  • A mental or physical disability prevents the spouse from meeting his or her reasonable needs.
  • A child's disability prevents a spouse from earning enough money to meet his or her reasonable needs.
  • The spouse from whom maintenance is requested was convicted of or received deferred adjudication of an act of family violence during the divorce or within two years of filing.

Even if a court decides that spousal maintenance is necessary, time and income limits apply. Our lawyers fully understand how these laws will impact your situation. Even if spousal maintenance is not available in your divorce, we may be able to assist you in dividing your marital assets in such a way that accomplishes your goals.
